The Organization, for the purposes of these Terms, refers to The Mr. CTO, obrt za savjetovanje i usluge, vl. Ivan Golubić, with its registered business address at Bregana Pisarovinska 37, 10451 Pisarovina, Croatia, VAT ID (OIB): 48036835495, and Registration Number (MBO): 99003384 (hereinafter: the Organization).
I. APPLICATION OF THE GENERAL TERMS OF USE
1. In case of access and/or use of the domain themrcto.com and all related subdomains (hereinafter: "web service") and associated content (for example: text, photos, audiovisual and musical works), the application, software and services that are made possible through the web service, regardless of the way of use, the User expressly agrees without any restrictions or reservations to the use and use of the web service in accordance with these General Terms of Use (hereinafter: "Terms"), and the regulation of all legal relations that arise or may arise from the use/use of the web service is carried out in accordance with these Terms.
2. The Organization reserves the right to change, limit or terminate the provision of the web service at any time, including access to the web service. The Organization reserves the right to partially or completely limit the provision of certain services, as stated below in these Terms, and in case of violation of the provisions of the Terms.
3. By using the content of the web service, the user accepts all risks arising from such use and undertakes to use the content exclusively for personal use and at their own risk.
4. These General Terms of Use are valid from the moment of their publication. The Organization reserves the right to change these Terms of Use at any time and will not be responsible for any possible consequences resulting from such changes. The aforementioned changes come into force upon publication on these websites.
II. WEB SERVICE CONTENT, SOFTWARE, SERVICES AND APPLICATIONS
5. Documents, data, and information published on the web service may not be reproduced, distributed, or in any way used in a manner that is contrary to these Terms.
6. The content, visual identity, application, and software are protected in accordance with the provisions of the Copyright and Related Rights Act, the Trademark Act, and the Criminal Code. In particular, it is expressly forbidden to change, publish, transmit, sell, display, process, copy or in any other way exploit the content, visual identity, applications and software of the web service, except exceptionally when such possibility is provided for in these Terms or is the result of prior approval by the Organization.
7. It is forbidden to use the services of the web service for commercial purposes. Storage or copying of content for any purpose other than personal use is expressly prohibited. It is especially forbidden to use the web service in such a way that access to it can be done through another page or portal via a link, or in another similar way that allows web service pages to be opened within someone else's domain, portal, or page.
8. The holder of all exploitation rights and other rights to the content of the web service is the Organization. Certain content may be downloaded or created by partners (for example: Unsplash, etc.), in which case the Organization is not responsible for delays, inaccuracies, errors, and possible damage resulting from such content, applications, and software. The Organization is not responsible for any form of damage caused by unauthorized and/or improper use and/or misuse of the web service by the user.
9. In case of unauthorized, illegal, and/or illegal use of any content (text, photos, applications, software, audiovisual and musical works) of the web service, it reserves the right to claim compensation for all damages and initiate civil and criminal proceedings before competent courts.
10. The use of web services is approved for adults. The use and use of web services by children is only allowed under the supervision of parents and/or guardians, and they are obliged to take care of this, otherwise, they assume all rights and obligations arising from such use, and the Organization is not responsible for any consequences of such use.
III. USE OF CONTENT THAT THE USER MAKES AVAILABLE OR SUBMITS TO THE ORGANIZATION
11. By using the web service, the user acknowledges and agrees that any content (for example: comments, messages, reviews, reviews, texts, photos, video and audio content, computer codes and applications) that he has made available on the web service or has submitted subject to the Organization's use and free use/exploitation by the Organization, in such a way that it can be edited, processed, removed in part or in whole, modified, published and/or transmitted to any way and in any format, including the so-called "RSS feed" and all in accordance with these Terms.
12. It is considered that every delivery of content created by users of the Organization, as well as every publication or otherwise making content available to the public through web services, represents the user's acceptance of the Organization's offer to enter into a legal transaction according to the conditions contained in these Terms, and the subject which legal transaction is the assignment of that user content and the transfer of rights to the same in favor of the Organization.
13. Any publication of content created by the user on the web service (whether automated or through the web service), as well as any delivery of certain content to the Organization, is considered the user's acceptance of the Organization's offer. The organization's offer applies to all adults and refers to enabling the publication of content (created by the user himself) via web services and other media for a certain period of time, which content the user previously submits to the Organization or publishes/writes independently, or communicate through the web service, and in that case the Organization acquires the right to use that content without paying a special fee (except when it is expressly emphasized or communicated for a specific case) and without content, space and time limitations, especially in such a way that the content: uses, transmits, processes, edits, publishes, communicates to the public, adapts, publicly performs and/or displays, further broadcasts or adapts/reproduces via streaming, downloading, broadcasting, thumbnails or any other media. Based on such acceptance, the user and the Organization are considered to have entered into a legal transaction according to the terms of this point.
14. The Organization will take care to use such user content in accordance with good business practice, in an appropriate manner. The content created by the user means in particular: comments, messages, reviews, criticisms, texts, reviews, photos, video and audio content, illustrations, and audiovisual content.
15. The user guarantees that he owns all the rights to the content he delivers to the Organization and that there are no rights of third parties on the same that diminish or could diminish the rights that the Organization acquires on that content. In the case of any claims by third parties based on compensation for damages against the Organization, which are related to the delivered content on any basis, the User undertakes to take all actions to prevent or eliminate damage (non-property or property), and undertakes to third parties in writing form to make all necessary statements that the Organization disposed of the content in question in good faith and had no reason to suspect that the user does not have rights to the content.
16. The user is personally responsible for his content that he publishes or makes available on the web service, since the Organization cannot control and/or revise each user's post and is not responsible for its content.Pursuant to Article 94 of the Electronic Media Act, commenting on articles on the Organization's web service is allowed only to registered users. Every user who wants to comment on articles is obliged to familiarize themselves with the Rules of Conduct on the Organization web service and with the prohibitions prescribed in paragraph 2 of Article 94 of the Act.
IV. CONTENT POSTED BY USERS
17. Rules of conduct
In order to keep communication on the web portal decent and to ensure that communication takes place with mutual respect for all participants, each user of the services of this web service accepts the following rules of conduct and is obliged to comply with them when using our services.
If there are changes to the provisions of the Terms of Use regarding content published by users of the web service, we will inform you about them.
17.1. General provisions
When communicating with other web service users, be considerate and tolerant. Treat others with respect. Be careful about the content of your posts and comments. Each user is independently responsible for the content they publish on this web service. Published user content must comply with legal provisions and respect the rights of third parties.
17.2. Restrictions on posting content
The freedom to publish the content of each user will be limited to the extent that this content violates the rights of other persons or is contrary to legal regulations. Spreading illegal content or content that violates the rights of other people or is against moral principles is not acceptable on this web service. Any user may bear legal consequences for violating legal regulations by publishing inappropriate content. The content published on this web service must in no case violate the following criteria:
- Fraud: Content that intentionally deceives or exploits other users or third parties, or intentionally misrepresents facts in order to induce other natural or legal persons to act or refrain from acting in a manner that damages the property of those persons or other natural or legal persons with the aim of acquiring their property. Statements promoting or coordinating such activities are also prohibited.
- Data protection and privacy: Content that contains, requests, or offers personal or confidential information from other users or third parties, such as medical information, address, or financial information, is prohibited.
- Violence: Content that incites, supports, or calls for violence is prohibited. Statements threatening death or injury to other persons are also prohibited. Furthermore, content that offers or requests the commission of violence is prohibited, as well as content that advocates such behavior or glorifies violence, including humorous content if it is stated in a violent context.
- Defamation, discrimination, and/or hate speech: Content that incites hatred or belittles, insults, denigrates, or harms certain persons or groups is prohibited. Content directed against certain ethnic groups, religions, sexual orientation, gender, sexual identity, disability or serious illness or other persons is prohibited.
- Illegal and/or unsafe products: Content that sells, buys, offers, advertises, donates, gives away, or otherwise trades illegal and/or unsafe products is prohibited. Such products include, but are not limited to: drugs, prescription drugs, endangered animals and plants, etc.
- Bullying, stalking, and/or intimidation: Content aimed at making fun of people is prohibited. Content that is considered constant unwanted contact or serves to intimidate others, such as threatening messages, is also prohibited.
- Fake news or manipulative content is prohibited.
- Violation of personal rights: Content that violates the personal rights of third parties (such as honor or the right to personality) is prohibited. Discrediting or defaming a person is also prohibited. Content that illegally invades the honor and privacy of other persons is prohibited. This prohibition includes, in particular, the sharing of photos or content that uses the characteristics of third parties without their consent.
- Pornography or Sexualized Content: Sexual content, including but not limited to photographs or other depictions of nudity or sexual acts, is prohibited. Offering sexual services is also prohibited.
- Risk to public safety: Content that can be considered a serious threat to public safety is prohibited. This prohibition includes, but is not limited to, any content that contains statements of intent, threats, or calls for violence against specific persons, groups, or property, or for the manufacture of weapons or explosives.
- Protection of minors: Content that endangers the safety of minors is prohibited, which in particular includes content that may cause physical, psychological, or moral harm to minors.
- Self-harm: Content that intentionally or unintentionally promotes, glorifies, or encourages suicide or self-harm is prohibited. Debates or discussions on this topic are allowed only if they are objective and considerate.
- Terrorist content: Content that directly or indirectly encourages the commission of terrorist acts, glorifies or advocates terrorist activities, calls for participation in terrorist organizations or their financing, or advocates or contains threats to commit terrorist acts. Furthermore, content containing instructions on the manufacture and use of explosives, firearms, or other weapons as well as harmful and dangerous substances and chemical, biological, radioactive, and nuclear substance,s or instructions on other methods or procedures with the aim of encouraging or contributing to the commission of terrorist acts is prohibited. Terrorist acts are acts committed with the aim of seriously intimidating the population, illegally forcing public bodies or international organizations to act or refrain from acting, or seriously destabilizing or destroying the basic political, constitutional, economic, or social structure of a state or international organization.
- Animal welfare: Content that is against animal welfare is prohibited, such as content that trivializes animal cruelty or is aimed at encouraging others to cause harm and suffering to animals.
- Violation of intellectual property: It is mandatory to respect the copyright and other intellectual rights of third parties. Sharing of content containing copyright or other intellectual rights is permitted only with the consent of the holder of the copyright or other intellectual rights to that content. Content that violates the copyright or intellectual rights of third parties is prohibited.
- Other: The following content is also prohibited:
- capitalization on purpose
- offtopic commenting
- spamming or advertising by posting links or otherwise
- citing offensive comments or any other comments that are not allowed on the portal
- using a vulgar or offensive username and a username that contains the name and surname of another person
- calling the administrator or arguing with the administrator in any way
- intentionally disrupting discussions by inserting repetitive and/or contentless messages and comments
17.3. Obligation to report to competent authorities and judicial authorities
In accordance with the relevant legal provisions, users may be legally responsible for the content they publish on this web service. The Organization reserves the right to submit published user content or user data to government agencies, competent authorities and judicial authorities in accordance with the obligations under Article 18 of Regulation (EU) 2022/2065 (Digital Services Act) and Article 14 paragraph 5 of Regulation (EU) 2021 /784 on the fight against the spread of terrorist content on the Internet, and for the purposes of conducting an investigation of the content published by the user. The user may be obliged to submit certain data at the request of state agencies, competent authorities, and judicial authorities. We are obliged to notify the competent authorities and judicial authorities without delay and submit all relevant information as soon as we become aware of information that leads to the suspicion that a criminal offense has been committed or is likely to be committed or that a criminal offense is being committed that involves a threat to life or safety of a person or persons.
18. Moderation of user content
In order to ensure that the content published by users is in accordance with legal regulations and in accordance with the rules of conduct of these Terms of Use, we conduct moderation of content published by users, which we determine is against these Terms of Use or legal regulations.
18.1. Actions that contribute to restricting content
We have enabled users of our web service to report to us content that they consider illegal or contrary to these Terms of Use. Registration can be done via e-mail at hi@themrcto.com. We will consider the notification received about such content without delay and in accordance with the provisions of Regulation (EU) 2022/2065 (Digital Services Act).
Additionally, if through our own review of posted content we become aware of any illegal content or content that is contrary to our Terms of Use, we will moderate it in accordance with these Terms of Use.
18.2. The restrictions we apply
We apply the following restrictive measures to prevent the publication of illegal content or content that is contrary to these Terms of Use:
18.2.1. Content removal
If we learn that certain content is illegal or contrary to these Terms of Use, we will remove such content from our web service. The disputed content will no longer be publicly available after we apply this restriction measure.
18.2.2. Temporary suspension of the user account
If a certain user repeatedly publishes content that is illegal or contrary to these Terms of Use, and we have applied the measure from point 18.2.1. repeatedly or if the user has committed a particularly serious violation of these Terms of Use, we will permanently suspend the user's account.
V. REGISTRATION, USER ACCOUNT
19. In the process of registering or creating a user account, the user is obliged to choose the name or names under which he will provide services and choose a security password, and submit a valid e-mail address, all based on separate and informed consent to the Privacy Policy. All information required to register or create a user account must be true.
20. Registration or user account is created only for one person and it is not allowed to communicate information about the registration or user account to third parties. The user is obliged to keep information about their security password and user account. The use of someone else's registration or user account is not allowed.
YOU. PROTECTION OF INTELLECTUAL PROPERTY RIGHTS
21. The Organization is the holder of copyright and related rights on databases and related services, including part of the programming code, and on other works and objects of related rights created in the employment relationship or on order.
22. The Organization reserves all its exclusive copyright and related rights.
23. Any unauthorized reproduction, distribution in any way, and processing of the entire content or any part of the content on the web service without prior written approval is considered a violation of the Organization's copyright and related rights.
24. When someone uses parts of the web service that are considered the content of the web service for the creation of their media and/or other public announcements, they are obliged to indicate the Organization as the source they used, by marking in an appropriate, clear, and visible way:
- the name of the Organization web service as the source
- name and surname of the author who is signed on the Organization web service
25. The Organization retains all its copyright and related rights on all content of the Organization's web service, including metadata. Also, the use of published articles and photos from the Organization service is not permitted without the Organization's prior written approval.
26. A person who believes that the Organization has violated his or her copyright and related rights is authorized to immediately report such violation to the Organization and mark which content on the Organization's website he or she considers infringing. The Organization will consider any such report immediately and, in the event of a violation, will remove the disputed content as soon as possible.
VII. IN GENERAL
28. These Terms and Conditions are interpreted and applied in accordance with the law of the Republic of Croatia, and in the event of a dispute, the court in Zagreb has exclusive jurisdiction.
